SMS messaging policy

This SMS Messaging Policy (“Policy”) governs the Short Message Service (“SMS”) and Multimedia Messaging Service (“MMS”) communications that 86d (“Company”, “we”, “us”, or “our”) sends to users of our commerce platform (“Service”). It covers what you consent to, what we send, how to stop it, what we do with your number, and where we’re not liable. By giving us your mobile telephone number and opting into our SMS communications, you acknowledge that you have read and understood this Policy and agree to be bound by it.
Section 1: Consent and authorization
By giving us your mobile telephone number and expressly opting into our SMS messaging service, you consent to receive text messages from 86d at that number. This consent constitutes a written agreement under applicable federal and state law, including but not limited to the Telephone Consumer Protection Act (“TCPA”).
Your consent to receive SMS communications isn’t a condition of buying or using any goods or services we offer, except where such communications are essential to providing the Service.
You represent and warrant that you are the authorized user of the mobile telephone number you provide and that you have the authority to give this consent.
Section 2: Message content, purpose, and frequency
We send SMS communications for legitimate business purposes, including but not limited to:
- Two-factor authentication and account verification codes
- Account security notifications and authorization requests
- Service-related notifications and updates after you subscribe to our Service
- Transactional messages about your account and subscriptions
- Announcements about changes to our Service or our policies
Message frequency varies with your account activity, subscription level, and security requirements. You may receive several messages per month depending on how you use the Service. Your wireless carrier’s standard message and data rates may apply to every SMS communication.
Section 3: Opt out and unsubscribe
You can revoke your consent at any time. Reply STOP to any text message you receive from us. When we receive your opt-out request, we will:
- Immediately stop sending promotional and non-essential SMS communications
- Send one final message confirming your opt-out
- Remove your mobile number from our SMS marketing lists
Opting out may not stop essential account messages that we need to send to provide the Service, including security alerts and critical account notifications.
To turn SMS communications back on after opting out, you must expressly re-consent through our Service interface or through any re-subscription process we provide.
Section 4: Customer support and help
Reply HELP to any text message from us for help with our SMS messaging service. You’ll get information about the service, instructions for unsubscribing, and customer support contact details.

Section 5: Data collection, use, and privacy
We collect and process your mobile telephone number and related messaging data to deliver the communications you requested and to maintain our Service.
We don’t sell, rent, lease, or otherwise monetize your mobile telephone number or SMS communication data to third parties for their marketing purposes.
We may share your mobile number and associated data with trusted third-party service providers, including SMS platform providers and telecommunications carriers. Those providers are contractually obligated to keep the information confidential and secure, and to use it solely to deliver our SMS communications.

Section 6: Disclaimer of warranties and limitation of liability
SMS communications are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, about the reliability, availability, timeliness, or accuracy of SMS delivery.
Neither the Company nor its affiliates, service providers, or wireless carriers shall be liable for delayed, undelivered, misdirected, or otherwise failed SMS communications. SMS delivery depends on network availability, carrier policies, device compatibility, and other factors beyond our control.
In no event shall the Company be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to SMS communications, including but not limited to damages for lost profits, business interruption, or loss of data.
Section 7: Compliance and legal requirements
Our SMS communications comply with applicable federal and state law and regulation, including the TCPA, the CAN-SPAM Act, and other relevant telecommunications and privacy laws.
By consenting to receive SMS communications, you agree to comply with the laws and regulations of your jurisdiction governing the receipt and use of such communications.
Section 8: How this Policy fits with our other terms
This Policy supplements and is incorporated into our Terms of Service and Privacy Policy. By agreeing to receive SMS communications, you also agree to be bound by our:

Section 9: Policy updates
We reserve the right to modify this Policy at any time by posting the updated version on our website. We’ll communicate material changes by SMS or through other appropriate means. If you keep using our SMS service after we give notice of a change, you accept the modified Policy.
